The court denied Ivanka Trump’s request to postpone her upcoming testimony in her father’s civil fraud trial on November 2. She said she would suffer undue hardship if she is forced to appear during the school week.

“Ms Trump, who resides in Florida with her three minor children, will suffer undue hardship if a stay is denied and she is required to testify at trial in New York in the middle of a school week, in a case she has already been dismissed from, before her appeal is heard,” said her lawyer in an appeal filed on October 31.

The appeal sought to block New York Judge Arthur Engoron’s previous order for her to testify until an appeal could be heard by the New York appellate court. The appeal is also seeking an order to pause the entire fraud trial against former President Donald Trump, two of his adult sons and his company until his appeal can be heard. The motion was denied.

The appeal was rejected and New York Attorney General Letitia James said that the motion was a “drastic” and baseless move that “would upend an ongoing trial.”

Ivanka Trump’s two brothers – Donald Trump Jr and Eric Trump who both helped run the Trump organisation appeared in court on November 2 while Donald Trump will testify on Monday.

Ivanka is now expected to testify next Wednesday, November 8, after her dad’s testimony on November 6.

Ivanka Trump’s attorney argued that the New York civil court has no jurisdiction to force her to testify as she has not lived or worked in New York since 2017 and is also not a co-defendant in the case.

Earlier this year, in June, New York appeals court dismissed Ivanka Trump as a co-defendant, finding the claims against her were too old. The court also ruled that she was not part of the August 2021 agreement between New York Attorney General Letitia James’ office and the Trump organisation to toll the statute of limitation.
